Federal Government has officially closed its case against Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), after presenting its fifth and final witness in the terrorism trial currently ongoing at the Federal High Court in Abuja.
The case involves an eight-count charge bordering on terrorism, which Kanu has consistently denied.
The prosecution’s final witness, identified only as Mr EEE, is a Department of State Services (DSS) operative based in Abuja. He informed the court that he had never personally met Kanu and knew of him only through the media.
According to his testimony, he led a team of DSS officers to southern Nigeria to gather records of violent incidents between 2020 and 2021, during the EndSARS protests. His report highlighted:
- 128 police officers killed
- 37 army officers and 10 DSS officers also lost
- 164 police stations and 19 INEC offices destroyed during the unrest
However, under cross-examination, Mr EEE admitted that:
- He was not involved in any investigation linking Kanu directly to those incidents
- He had no knowledge of IPOB involvement in events in Lagos, Ibadan, or Ile-Ife
- He was unaware of the Lagos State Judicial Panel findings, which did not implicate IPOB in the EndSARS protest violence
Following this, the Federal Government formally closed its case, stating it had presented sufficient evidence to prove its charges.
Kanu’s lead counsel, Kanu Agabi (SAN), informed the court that the defence would file a no-case submission, arguing that the prosecution had failed to establish a prima facie case against his client.
Justice James Omotosho granted the defence 14 days from June 24 to file their submission, with an additional 14 days granted to the prosecution for their reply.
The matter has been adjourned to July 18, 2025, for the adoption of written addresses on the no-case submission.
